City of Carmel Ordinance Violation Deferral Program

You may be eligible for the City of Carmel Ordinance Violation Deferral Program (“Program”). This Program, if successfully completed, allows you to avoid having points and a conviction applied to your driving record as a result of the City ordinance violation for which you have just been cited. The following is a summary of Program requirements, not a complete recitation of Program terms and conditions.

  • You must pay a Program fee in lieu of paying your ticket
  • You must agree, in writing and under oath, to all the terms of your Deferral Agreement. These terms always include a “deferral period,” during which you cannot violate any traffic or other law. If you comply with all of the terms of your Deferral Agreement, your pending ticket will be dismissed.
  • In order to be eligible for deferral, you must have had no convictions, diversions, or deferrals within the past twelve (12) months, no active points on your driving record, and no charges currently pending against you in any jurisdiction. Some offenses, such as speeding in a school zone, and some individuals, such as those holding an active commercial driver’s license, may not be eligible for deferral.
  • If you are interested in this Program, you must contact the Carmel Deferral Program Coordinator at 317-571-2775 or 317-571-2472 no later than seven (7) calendar days before the date of your initial court appearance. If you are eligible for and enter the Program, all Program fees must be paid by cashier’s check or money order only and all Program documents must be properly executed and returned to the Deferral Program Coordinator no later than two (2) business days before the date of your initial court appearance. If you do not comply with the above time limits, you will not be eligible for the Deferral Program even if you obtain a continuation of your initial court appearance date.
  • The final decision on Program eligibility and on Deferral Agreement terms rests with the Carmel Corporation Counsel. Neither the Carmel Police Department nor the police officer who handed you this Program summary sheet can establish Deferral Agreement terms or determine Program eligibility. Entry into the City of Carmel Ordinance Violation Deferral Program is completely voluntary.
