Right-of-Way permits are required for any construction, excavation, aerial utility installation, restriction of traffic (vehicle and pedestrian), or use of a construction entrance within the City of Carmel’s dedicated Right-of-Way and easements. This requirement applies to construction activity that utilizes heavy equipment (skid steer or larger) located on private property that is accessed from a public street or alley, including access from an existing driveway. Depending on the scope of each project, additional permits and approvals may be required prior to issuance of a Right-of-Way permit.

Applying for a Permit

Permit applications are submitted electronically through the City of Carmel’s online permit portal. Applicants must set up an account using a valid email address prior to submitting any permits. In addition to Right-of-Way permits, the account can be used to submit many other types of construction related permits that may be required.

Bond Requirements

Right-of-Way Permit applicants must file a valid License and Permit bond with the Engineering Department. Applicants that frequently file permits can maintain a blanket bond for use on multiple permits. Bonds should be payable to the City of Carmel with a minimum coverage of $5,000 and remain in effect for the duration of a permitted project. Larger bond coverage may be required when deemed necessary due to the project scope of work.

Additional Requirements

The following construction related activities may require Board of Public Works and Safety (BPW) approval prior to issuance of a Right-of-Way permit:

  • Lane or street closures
  • Path or sidewalk closures
  • Pavement Cuts
  • New driveway curb cuts
  • Relocation or abandonment of existing curb cuts
  • Easement encroachments for private infrastructure
  • Utility pole and aerial utility installation
  • Design standard waivers

BPW meetings are typically held the first and third Wednesday of every month with a filing deadline one week prior to each meeting.
